What exactly do you mean by "it's up" ? What flags does ifconfig
report for this card (UP, RUNNING, etc.) ?

My guess is that the driver function for shutting down the card the
card is not called and does not get to set the card into the proper
power mode. When you set an IP, the function is called and the proper
power mode is set.
